Official Notice of Grievance

BACKGROUND INFORMATION:

The federal government has overstepped its bounds with respect to the restrictions placed upon it by the Bill of Rights. Our government is exercising powers it has not been given, and it's showing no signs of slowing down. Calling Congress on the carpet is very serious business. This Action Campaign in particular is not a "Hallmark" moment.

Who is responsible for enforcing the Bill of Rights? Is Congress, or the Attorney General, or the Speaker of the House? Are they charged with the duty to enforce the limits on themselves? Hardly. The limits on government are enforceable only by the Fourth Branch of government -- we the people! We need to speak with a singular voice as the quintessential branch of governance. "You have no delegated power to take money from us in taxes and give it to businesses you deem poorly run. You don't. Whatever consequences you promise, whatever horrors you predict, you lack power to address the invented problems in this manner. You must immediately cease and desist."

We must express in no uncertain terms our anger that government has stepped so far outside its delegated boundaries. They are exercising unchecked powers, intruding into aspects of our lives that would have appalled the Founders, infringing upon or virtually eradicating freedoms we hold dear, and failing in its primary obligation -- the protection of our freedoms and rights.

The government is not likely to appreciate any direct threat to its powers -- which the Bill of Rights specifically represents -- especially as it is held high by an angered people. The very idea that the people would take it upon themselves to examine government's abuses, usurpations of powers, abuses of authority, and contraventions of the very Bill that is meant to constrain government actions, is inflammatory.

How will government react to this frontal assault on itself by the Fourth Branch of government, we the people? Will Barney Frank, Nancy Pelosi and Harry Reid sit idly by and say, "yes, you're right, we screwed up, we'll leave you alone now"? Or do they see our challenges as extra-legal, unwarranted intrusion, subversions of their unchallenged authority, and cause for retribution and retaliation? What do they tell their compliant press corps to tell the masses about all this? Will they vilify and threaten ruination as they did "Joe, the Plumber"? You bet they will. Dear friends, we are in a fight for the very existence of our country. This battle cannot be taken lightly.

Congress is opposed to the will of "We The People". Apparently, Congress believes "We" do not have the intelligence or the common sense needed for self-governance and we must rely on the federal government to do what's best for all of us. Here's a quote from Barney Frank from June 16th, 2009: “The left and the right live in parallel universes,” Frank told POLITICO. “The right listens to talk radio, the left’s on the Internet and they just reinforce one another. They have no sense of reality. ... ”

This is not a partisan battle. This is not about the Republicans vs. the Democrats, the left vs. right, liberal vs. conservative. This is about the government vs. you. This is statism vs. individual freedom. This is about your individual liberty, your rights and freedoms - and once gone (Yes, even your right of free speech), the left, the right, and everyone in-between will no longer have a voice to champion their cause. Do you get it yet? It's all at stake here and I don't know how to make this any clearer.

I strongly invite everyone from the full political spectrum to take part in this "Action Campaign". If you're part of the liberal left, you may not agree with conservative principles - but at least you have (for now) that right to disagree. The same applies to the conservative right. For all the political drawbacks of the classic "libertarian" philosophy, its underlying adoration of personal freedom, the right to be left alone, the right to do as you please as long as you harm no one, this must be rekindled within each of us regardless of where you fall politically.

The following letter is to be sent weekly to each of your US Senators. Send it to their Washington, D.C. address as well as each local district office(s) in your home state. In addition, enter your zip code here and send it as a "letter to the editor" to each of your local media outlets. Who knows - some may actually print it!

The letter below uses the phrase "high crimes". "High crimes and misdemeanors" is a phrase from Section 4 of Article Two of the United States Constitution: "The President, Vice President and all civil officers of the United States, shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors." "High" in the legal parlance of the 18th century means "against the State". A high crime is one which seeks the overthrow of the country, which gives aid or comfort to its enemies, or which injures the country to the profit of an individual or group. In democracies and similar societies it also includes crimes which attempt to alter the outcome of elections.

SAMPLE LETTER OR EMAIL:

This letter shall constitute an Official Notice of Grievance. I state my grievance, not as a democrat or republican, not as a liberal or conservative, but as an American.

In spite of perhaps differing political ideologies, we have much in common - the Constitution with its Bill of Rights, and our other founding documents. You were elected to represent and swore an oath to protect our constitutional principles, but it has become evident that you have abandoned both your oath and those values you’ve swore to uphold.

You have stepped far outside your delegated boundaries. You are exercising unchecked powers, intruding into aspects of our lives that would have appalled America's Founders, infringing upon or virtually eradicating freedoms we hold dear, and failing in your primary obligation -- the protection of our freedoms and rights.

Our President has stated that "the people have spoken in November". This DID NOT grant the President, you, or any other elected official the authority to change the very foundation and framework of our nation!

I would respectfully remind you and our other elected representatives of Congress, this great land is a constitutional Republic - NOT a democracy. The notion of "we won" or of governing as a majority is nothing short of tyranny or mob rule at best. Our republic was founded on the principal that the individual liberty of all is paramount above all and the liberty of one individual is not subject to the whims, wants and desires of another individual or group of individuals, regardless of majority opinion. You, as an elected representative, irrespective of political ideology, have not been granted the authority or power to add to, subtract from or otherwise modify and violate the constitutional rights of another, simply because you represent 50% + 1 of the voting populace. You must protect the Constitution, our rights, and represent ALL your constituents, not just those of majority.

I will not get into debate to prove these matters to you when our founding documents should be proof enough. Your actions have been egregious and your defense is no longer relevant. You DO NOT work for the President! You DO NOT work for the Treasury! You DO NOT work for any special interest group! You work for ME! You are a steward selected to protect and defend, not redefine, our Constitution or Republic. You are to apply the checks and balances granted you by our Constitution and your constituents to PREVENT ABUSES by government and further prevent the overthrow of the Constitution for the United States.

You cannot, you must not, without the grossest corruption, continue down the path the administration has chosen. You do not have the delegated authority to do so.

• You, nor the president, have any delegated power to take taxpayer dollars and give it to private banking or private businesses you deem poorly run regardless of circumstance.
• You, nor the president, have any delegated power to take control of, or assign unelected and unaccountable "czars" control over, private banking or private businesses.
• You, nor the president, have any delegated power to mandate increased unrepresented taxation due to ill-conceived or unread legislation (the Stimulus, Cap & Trade, etc).
• You, nor the president, have any delegated power to mandate through "reform", that all Americans take some form of National Health Insurance.

This list of “high crimes” against America and its people is by no means complete. Whatever consequences you promise, whatever horrors you predict, you lack power to address the invented problems in this manner. You must immediately cease and desist. To continue this madness is in violation of the peoples trust, a violation of your oath of office and threatens the very existence of our Republic. To continue in actions that diminish the liberty of any American citizen or, through unauthorized and unbridled spending, provide an obscene debt for all for generations to come, is a further breach of the "rule of law" in the most repugnant sense, by the government of the United States and further, is a nullification of the Constitution for the United States of America by the government of the United States. Your actions in the Senate, in tandem with the House of Representatives, brings the entire institution of the Legislative Branch of the US government into open complicity in treasonous behavior with the Executive Branch and WILL NOT BE TOLERATED!

If you do not stand with the American people; if you are not willing to abide by our representative, republican form of government, if you are not in agreement with government "Of, For, and By The People", then I expect your immediate resignation.

If you do stand in agreement with our representative, republican form of government, I expect a personal written explanation within 15 days of receipt of this notice detailing the immediate actions you will undertake to reverse the perversions inflicted upon the American people since January 20th, 2009.
